1. Agreement to Terms

By accessing or using the services provided by Express Consent LLC (“ExpressConsent,” “we,” “us,” or “our”), including the website at expressconsent.com and all related services (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

2. Description of Service

ExpressConsent is a consent evidence platform that enables businesses to capture, store, and retrieve visual and technical records of user consent events. The Service includes a browser SDK, cloud-based rendering and storage infrastructure, a web dashboard, and APIs for accessing consent evidence.

3. Accounts

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Acceptable Use

You agree not to:

  • Use the Service for any purpose that is unlawful or prohibited by these Terms
  • Interfere with or disrupt the integrity or performance of the Service
  • Attempt to gain unauthorized access to the Service or its related systems
  • Reverse-engineer, decompile, or disassemble any part of the Service
  • Use the Service to store or transmit material that infringes on any third party’s intellectual property rights

5. Consent Evidence Data

You retain ownership of all consent evidence data captured through the Service on your behalf. We store this data for a minimum of five (5) years in accordance with applicable statute-of-limitations requirements. You are responsible for ensuring that your use of the Service complies with all applicable privacy and consent laws, including but not limited to the TCPA.

6. Billing and Payment

The Service is billed on a pay-per-snapshot basis. You agree to pay all fees associated with your use of the Service. Fees are non-refundable except as required by law. We reserve the right to change our pricing with reasonable advance notice.

7. Data Sharing and Access

The Service allows you to share consent evidence with authorized third parties. Once consent evidence has been collected (billing incurred), any party you grant access to may view and download that evidence without additional charges. You are responsible for managing access to your consent evidence.

8. Intellectual Property

The Service, including all software, design, text, and graphics, is the property of Express Consent LLC and is protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, service marks, or trade names.

9. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or completely secure. We make no warranty regarding the accuracy or reliability of any information obtained through the Service.

10. Limitation of Liability

To the maximum extent permitted by law, Express Consent LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data or use, arising out of or in connection with these Terms or the Service.

11. Indemnification

You agree to indemnify, defend, and hold harmless Express Consent LLC and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from your use of the Service or your violation of these Terms.

12. Termination

We may suspend or terminate your access to the Service at any time for any reason, including if we reasonably believe you have violated these Terms. Upon termination, your right to use the Service will immediately cease. Provisions that by their nature should survive termination will survive.

13. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Palm Beach County, Florida.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the revised Terms on this page and updating the “Last updated” date. Continued use of the Service after changes constitutes acceptance of the revised Terms.
